Alert-On Privacy Policy

Alert-On, LLC (“Alert-On”) offers an online service and reporting tool that allows companies (“Customers”) to track and identify website visitors (“Services”). The Services include, without limitation, any software code or scripts supplied by Alert-On, applications used to access the Services, Alert-On content, and services used or received by Alert-On. PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING OR INTERACTING WITH OUR SERVICES.

1. Privacy Statement

This Privacy Policy (“Privacy Policy”) provides information about (a) the information that we collect when you visit, interact with, provide information to or otherwise use (collectively, “Interact”) a website that utilizes our Services, (b) the ways in which we use your Personal Information (as defined below), and (c) your choices regarding use and disclosure of your Personal Information. By Interacting with a website that utilizes our Services, you (“you” or “your”) consent to the policies and practices described in this Privacy Policy. As used in this Privacy Policy, the term “Personal Information” means information that identifies you personally, alone or in combination with other information. Each time you Interact with a website that utilizes our Services, the current version of the Privacy Policy will apply. 2. Information Collected by Alert-On

When you Interact with a website that utilizes our Services, we collect information (a) that you knowingly and voluntarily provide (such as through web forms or profile screens), (b) that we are able to collect from cookies and other similar technologies, and (c) that we are able to gather from your web browser. We may aggregate and/or combine information that we collect, including without limitation Personal Information, for the purpose of offering the Services to our Customers. Such combination may result in otherwise non-identifying information being able to identify an individual.

Parties that we share this information with are listed in Section 5 (Who Can Access the Information We Collect). a. Information that you Knowingly and Willingly Provide. When you Interact with a Customer’s website, we collect information that you enter into a web form or profile screen. That information is limited to email address, phone number, full name and company at which you are employed. Which of those fields are collected is determined by the Customer controlling the website. Further, when you sign up to buy Services from Alert-On, we also collect registration/account setup information, profile details, and payment information. b. Information Collected by Cookies, Web Beacons and Other Technologies. We obtain information about you by installing cookies on your computer or device’s hard drive. We use cookies to track your activities on our Customers’ websites. If you do not wish to receive cookies, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer.

By Interacting with the websites that have integrate our Services, you consent to having our cookies on your computer or device. c. Browser Information. We collect information that is sent to us automatically by your web browser when you Interact with a website that uses the Services. We use this information to generate statistics about visitors to websites using the Services. The information we receive depends on your browser settings. Please check your browser if you want to learn what information your browser sends or how to change your settings.

This information typically includes, without limitation, details about your:

  • Page visited
  • Page referred

4. How Is Your Personal Information Used?

We use the Personal Information we collect to provide and improve our Services, content, and advertising. We also combine your Personal Information with other information obtained independently or from third party sources (e.g. from IP lookup service). We use Personal Information and other information collected as follows:

  • To create Customer accounts and/or profiles through registration;
  • To provide the Services to our Customers which includes idenifying visitors to their websites;
  • To perform internal operations, such as tracking and improving the effectiveness of our Services;
  • To provide support;
  • To resolve disputes involving Alert-On;
  • To conduct marketing research;
  • To conduct audits;
  • To provide information to our business partners and suppliers;
  • To provide information to our representatives and/or advisors, such as our attorneys, accountants, and others to help us comply with legal, accounting, or security requirements;
  • To transfer your information as part of a merger or sale of all or part of our business;
  • To protect the rights, safety, and information of our members, third parties, as well as our own; and
  • To comply with legal requirements, such as in response to a subpoena or similar investigative demand. We may also disclose your Personal Information as otherwise set forth in this Privacy Policy, as permitted by law, or with your consent.

5. Who Can Access the Information We Collect?

Alert-On may disclose your information that we collect including Personal Information in the following instances: a. Customers. We share information that we collect about you (including Personal Information) through the Services with our Customers even if you did not directly submit such Personal Information to those Customers. b. Employees. Our authorized employees have access to information that we collect about you including your Personal Information. c. Agents. We employ other companies and individuals to perform functions on our behalf. Examples of such functions include, without limitation, datacenter hosting services, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing technical support, providing marketing assistance, processing credit card payments, and providing customer service. We share our Personal Information that we have collected with these agents as we deem necessary for such third parties to perform their functions. d. Affiliates, Subsidiaries and Business Partners. We share Personal Information with our corporate subsidiaries, affiliates and business partners for uses consistent with this Privacy Policy. e. To Comply with Legal Process, Protect Alert-On, or Enforce our Rights. We may disclose your Personal Information when we believe it is necessary to (i) conform to legal requirements or comply with legal process; (ii) enforce or apply our conditions of use and other agreements (iii) protect the rights, safety or property of Alert-On, our affiliates, service providers, our users or the public, or (iv) prevent a crime or protect national security (including, without limitation, exchanging information with other companies and organizations for fraud protection and credit risk reduction). f. As Part of a Merger or Sale of All or Part of our Business. We may disclose your Personal Information in connection with a corporate transaction, such as the sale of all or part of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

6. Children and Privacy

To our knowledge, the websites which use our Services are not directed to children under the age of 13. If you are not 13 or older, do not Interact with websites that use our Services. We do not knowingly collect Personal Information from children under the age of 13. If we learn that Personal Information of persons less than 13 years-of-age has been collected through our Services, we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child or a minor under the age of 13 has posted, submitted or otherwise communicated Personal Information to our Services without your consent, then you may alert us at privacy@alert-on.com so that we may take appropriate action to remove the minor’s Personal Information from our systems.

7. Third Party Services

Alert-On is not responsible for the privacy policies or practices of any third party including, without limitation, websites that directly link to or integrate with our Services including our Customer’s websites.

8. Security, Storage, & Retention

a. Security. Alert-On takes reasonable technical and organizational precautions to protect the confidentiality, security and integrity of your Personal Information. Although we use security measures to help protect your Personal Information against loss, misuse or unauthorized disclosure, we cannot guarantee the security of information transmitted to us over the Internet. There is no guarantee that information may not be accessed, disclosed, altered or destroyed. b. Storage. The Personal Information that you provide to Alert-On is generally stored on servers located in the United States. If you are located in another jurisdiction, you should be aware that once your Personal Information is submitted through our Services, it will be transferred to our servers in the United States and that the United States currently does not have uniform data protection laws in place. c. Retention. We maintain information that we collect for as long as necessary to continue providing the Services and to otherwise comply with our obligations herein.

9. International Users

We are headquartered in the United States. Your Personal Information may be accessed by us or transferred to us in the United States or to our affiliates, partners, merchants, or service providers located in the United States. If you are visiting a website that uses our Services from outside the United States, be aware that your information will be (i) transferred to, stored, and processed in the United States where our servers are located, and our central database is operated and/or (ii) transferred to those third parties with whom we share it as described in this Privacy Policy. By using our Services, you consent to this transfer. By Interacting with a website that utilizes our Services, you explicitly acknowledge and consent to the fact that Personal Information stored or processed in the United States will be subject to the laws of the United States, including, without limitation, the ability of governments, courts or law enforcement or regulatory agencies of the United States to obtain disclosure of your Personal Information.

10. Changes to this Privacy Policy

From time to time, we may update this Privacy Policy to reflect feedback from our users or changes to our Services or privacy practices. If there are material changes to this Privacy Policy including to how we use, share or collect Personal Information, we will notify you by (i) revising the Effective Date at the top of this Privacy Policy, (ii) prominently posting an announcement of the changes through on our website, or (iii) if you are a Customer, sending you an email to the email address you most recently provided us in your account, profile or registration (unless we do not have such an email address). You are bound by any changes to the Privacy Policy after the date of the earliest of the foregoing notifications. We encourage you to review this Privacy Policy regularly to ensure that you are familiar with our current practices.

11. Information Correction, Removal, and Opting-Out

a. Correction & Removal. If any of the information that we have about you is incorrect, or you wish to have information (including, without limitation, Personal Information) removed from our records, please contact us at privacy@alert-on.com. We will respond to such inquiries within thirty (30) business days. b. Opting Out. Additionally, if you prefer not to participate in Alert-On’s Services, please let us know by contacting us below. Please note that even if we remove your information from our Services, it may not be possible for us to prevent us from receiving your information again in the future (e.g. if you were to fill in another web form at a Customer’s website).

Changes to this Privacy Policy

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes).
